1. Agreement to Terms

By accessing or using the Maplemark Digital website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services

Maplemark Digital provides digital services for businesses including but not limited to:

• Website design, development, and build
• Web hosting, maintenance, and SSL security
• Google Analytics setup and reporting
• E-commerce and online ordering

3. Client Responsibilities

As a client, you agree to:

• Provide accurate and complete information for your project
• Respond to communications in a timely manner
• Ensure you have the rights to any content you provide us
• Not use our services for any unlawful purpose
• Make payments according to the agreed schedule

4. Payments and Billing

Fees are billed as set out in your project proposal or service agreement. All prices are in Canadian Dollars (CAD) unless otherwise stated. For ongoing plans, you may cancel at any time, with cancellation taking effect at the end of the current billing period.

5. Intellectual Property

Upon full payment, you own the content and design of your website. Maplemark Digital retains the right to showcase completed work in our portfolio unless you request otherwise. Third-party tools, plugins, and stock assets remain subject to their respective licences.

6. Website Hosting

Websites hosted by Maplemark Digital are maintained on secure cloud servers. We aim for 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance windows will be communicated in advance when possible.

7. Money-Back Guarantee

We offer a 30-day money-back guarantee on our monthly service packages. If you are not satisfied within the first 30 days, contact us for a full refund.

8. Limitation of Liability

Maplemark Digital shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with our services. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

9. Termination

Either party may terminate the service agreement at any time. Upon termination:

• We will provide you with a copy of your website files upon request
• Hosting and related services will cease at the end of the billing period
• Domain names registered in your name remain your property

10. Modifications

We reserve the right to modify these terms at any time. Material changes will be communicated via email or notice on our website. Continued use of our services constitutes acceptance of modified terms.

11. Governing Law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada. Any disputes shall be resolved in the courts of Ontario, Canada.
